Slavery

Gallagher provocatively argues that the Confederacy walks, quacks, and should be understood as a republic — a position that has earned him hate mail wishing virulent pancreatic cancer upon him. Both sides in the Civil War claimed to be the true heirs of the founding generation and both adored the Declaration of Independence; they simply liked different parts. The states' rights argument receives a surgical takedown: it was not a specifically Southern value but a rhetorical weapon available to any side unhappy with federal power (New England used it during the War of 1812). The only specific state right the white South actually cared about was protecting slavery. The deepest irony follows: the states'-rights Confederacy passed America's first national draft, a national income tax, crop seizures, and suspended habeas corpus — becoming the most intrusive central government in American history until the 20th century.
