With the 'why' established, Hackett drills into the 'what': what exactly does the CLARITY Act put in place? Dixon starts with the most glaring gap in the current system — there is no federal regulator for crypto exchanges. The NYSE and NASDAQ have federal oversight; Coinbase and Kraken do not, and the now-defunct FTX never did. The Clarity Act empowers the SEC and CFTC with disclosure regimes, anti-fraud rules, insider trading prohibitions, and surveillance powers — all the grown-up financial infrastructure that FTX lacked. FTX's failure was ultimately simple: no proper auditing, no controls preventing money from moving between entities. A federally registered exchange couldn't have operated that way. Terra Luna — a 'stablecoin' with no real collateral backing, whose value was self-referential — would be flatly illegal under the Genius Act framework. Dixon acknowledges the bill is over 600 pages and has been in development for roughly seven years, but argues the details have been done before: financial industries have been regulated and the same principles apply here. He's particularly frustrated by news coverage claiming the bill lacks AML or sanctions provisions — it's simply not true, and dragging the bill text into ChatGPT would settle the question in minutes.
